1. Acceptance of Terms
By accessing or using the BrickPine Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. Platform Role Disclaimer
BrickPine operates as a technology intermediary. We do not own or sell listed goods, provide logistics services directly, or act as an agent for buyers or sellers. Transactions occur directly between users.
3. User Eligibility and Responsibilities
- Users must be at least 18 years old.
- Provide accurate, current information.
- Maintain account security.
- Use the Platform lawfully and responsibly.
4. Seller and Business Obligations
- Accuracy of listings and pricing
- Fulfillment and delivery performance
- Regulatory and tax compliance
- Customer service and dispute handling
5. Payments and Wallet Disclaimer
BrickPine provides wallet and payment facilitation tools. BrickPine is not a bank or financial institution and does not provide custody guarantees beyond operational handling.
6. Account Suspension and Termination
We may suspend or terminate accounts for:
- Policy violations
- Fraud or abuse
- Unlawful activity
- WhatsApp messaging violations
- Requests from Meta or regulators
7. Account Termination & Deletion
You may stop using the Platform and terminate your account at any time. Account deletion is available directly within the BrickPine app or via the BrickPine website, without needing to contact customer support. Account deletion works as follows:
- Immediate effect: Once deletion is initiated, your account and associated content (such as listings, reviews, and profile information) immediately become invisible to other users of the Platform.
- 30-day grace period: Your account then enters a 30-day grace period before permanent deletion, giving you time to recover your account if you change your mind.
- Self-service restoration: During the 30-day grace period, simply logging back into your account automatically cancels the deletion request and fully restores your account.
- Permanent deletion: If your account is not restored within 30 days, it is permanently deleted. Certain records, such as transaction and compliance data, may be retained thereafter only as described in our Privacy Policy.
- Effect of termination: BrickPine may also suspend or terminate your account under Section 6. Termination does not relieve you of obligations incurred, or liability arising, prior to termination.
8. Intellectual Property
All Platform software, content, trademarks, and designs are owned by BrickPine or its licensors. Unauthorized use is prohibited.
9. Limitation of Liability
To the maximum extent permitted by law, BrickPine is not liable for user-to-user disputes, losses arising from transactions, or indirect or consequential damages.
10. Informal Resolution
Before initiating formal legal proceedings, the parties agree to first attempt to resolve any dispute arising out of or relating to these Terms through good-faith negotiation, by contacting [email protected] with a written description of the dispute. If the dispute is not resolved within 30 days of such notice, either party may proceed to pursue any available legal remedy in accordance with Section 11 (Governing Law).
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Nigerian courts have exclusive jurisdiction.
12. User-Generated Content & Community Safety
BrickPine is a platform where users may post listings, reviews, messages, and other content. To maintain a safe, respectful, and compliant environment, the following rules and moderation standards apply to all user-generated content (UGC) on the Platform.
12.1 Zero Tolerance for Objectionable Content
BrickPine has a zero-tolerance policy for objectionable content and abusive behaviour. By using the Platform, you agree that you will not post, transmit, or share content that:
- Is defamatory, abusive, threatening, hateful, or discriminatory
- Is sexually explicit, obscene, or exploitative
- Violates the rights, privacy, or dignity of any person
- Promotes illegal activities or incites violence
- Constitutes spam, fraud, or misleading information
Violation of this policy may result in immediate content removal, account suspension, or permanent termination.
12.2 Content Moderation & Filtering
BrickPine employs automated and manual content moderation systems to detect and filter objectionable content before it is published or upon its identification. We reserve the right to review, remove, or restrict any content that violates these Terms at our sole discretion, without prior notice.
12.3 User Reporting of Objectionable Content
All users have the ability to flag content they believe violates our community standards. To report objectionable content:
- Tap the “Report” option on any listing, message, profile, or content item within the App.
- Select the reason for your report and submit.
- Our moderation team will review the report and take appropriate action.
BrickPine is committed to acting on valid reports of objectionable content within 24 hours of receipt. Upon confirmation of a violation, we will remove the offending content and, where warranted, eject or suspend the user responsible.
12.4 Blocking Abusive Users
Users may block other users to prevent further contact or interaction. When a user is blocked:
- The blocked user’s content is immediately removed from the blocking user’s feed and visibility.
- The blocked user can no longer contact, message, or interact with the user who blocked them.
- BrickPine is automatically notified of the block and will investigate patterns of abuse.
Blocking is immediate and effective in real time. Users who are blocked by multiple parties may face additional review and potential account action.
12.5 Developer Response to Content Reports
BrickPine Technologies Limited is committed to maintaining a safe platform. Upon receiving a report of objectionable content or abusive behaviour, we will:
- Acknowledge the report and begin review within 24 hours.
- Remove confirmed objectionable content promptly.
- Eject or suspend the user responsible for the offending content where appropriate.
- Notify the reporting user of the outcome where possible.
We reserve the right to take further action including permanent account termination, legal referral, or reporting to relevant authorities where content constitutes a criminal offence.
12.6 EULA Agreement for User-Generated Content
By creating an account and using the BrickPine Platform, you expressly agree to this End User Licence Agreement (EULA) as it relates to user-generated content. You acknowledge that:
- You are solely responsible for any content you post on the Platform.
- BrickPine does not endorse any user-generated content.
- BrickPine has the right but not the obligation to monitor, edit, or remove any content at its discretion.
- Your continued use of the Platform constitutes acceptance of these community content standards.
13. WhatsApp Messaging Terms
13.1 Message Categories
- Transactional: order updates, delivery notices, payment confirmations
- Promotional: marketing offers (only with separate consent)
13.2 Separate Promotional Consent
Promotional WhatsApp messages require explicit, separate opt-in and are not bundled with transactional consent.
13.3 Opt-Out
- Reply STOP
- Change in-app settings
- Contact support
Opt-out requests are honored promptly.
13.4 Prohibited Uses
- Spam or unsolicited bulk messaging
- Abuse or harassment
- Bypassing WhatsApp safeguards
- Harvesting or misusing contact data
13.5 Enforcement
We monitor messaging activity and may restrict, suspend, or terminate accounts to prevent abuse and maintain WhatsApp compliance.
14. Survival
Sections of these Terms that by their nature should survive termination or deletion of an account — including Intellectual Property, Limitation of Liability, Informal Resolution, Governing Law, and this Survival clause — will remain in effect after your account is terminated or deleted.
